Marketplace Role & Creator Responsibility

Aquarelia operates as an intermediary marketplace and cryptographic provenance registry. While automated systems inspect content for platform safety guidelines, Aquarelia does not pre-vet, audit, or guarantee the baseline copyright status or original ownership of user-uploaded assets.

Each creator is solely and individually responsible for the artwork they upload, certify, and sell. By publishing on Aquarelia, creators represent and warrant that:

• They possess all necessary rights, commercial licenses, and subscriptions for any underlying generative tools, software, or assets utilized.
• Their submissions do not infringe upon any third-party copyrights, trademarks, publicity rights, or intellectual property (including unauthorized replications of established characters or franchises).

Aquarelia assumes no legal liability for intellectual property disputes or unauthorized replications arising from user-submitted content.

Notice & Takedown Procedure (DMCA)

Aquarelia respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) and applicable international copyright frameworks. If you believe that your copyrighted work is being infringed on our network, please submit a formal notification containing:

• Identification of the copyrighted work claimed to have been infringed.
• The exact URL or direct link to the allegedly infringing material on Aquarelia.io.
• Your full contact information (legal name, physical address, telephone number, and email address).
• A statement of good faith belief that the disputed use is unauthorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notification is accurate and that you are authorized to act on behalf of the copyright owner.

Takedown Response & Counter-Notifications

Upon receiving a valid takedown notice, we will expeditiously remove or restrict access to the infringing material and notify the affected user, providing them with the opportunity to submit a formal counter-notification. In accordance with safe harbor provisions, Aquarelia maintains a policy of suspending or terminating accounts of repeat copyright infringers.

Platform Intellectual Property

While creators retain rights to their original works (subject to marketplace license transfers upon sale), the Aquarelia platform, including its codebase, backend architecture, proprietary interface, branding, and visual design, remains the exclusive intellectual property of Aquarelia.io. Unauthorized reproduction, data scraping, or theft of our platform's underlying technology is strictly prohibited.
