Acceptance of Terms
By accessing or utilizing the Aquarelia.io platform, you formally agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use our services. We reserve the right to update these Terms at any time, and your continued use of the platform constitutes acceptance of any changes.
An Ecosystem for Digital Art
Aquarelia is a dedicated sanctuary for digital art, fundamentally different from decentralized finance platforms or financial trading apps. We do not operate within speculative or decentralized frameworks, nor do we encourage our community to adopt a trading mindset. Our purpose is to empower creators to flourish by publishing their artworks, and to provide a place where collectors can explore and acquire works that deeply resonate with them. We encourage you to use Aquarelia not to trade, but to share, collect, and genuinely enjoy the profound beauty of art for what it truly is.
Intellectual Property
The original creator retains the underlying copyright to their generated artwork. However, upon a verified and successful financial transaction, the usage rights are immediately and mathematically bound to the new owner. These rights remain with the buyer until the asset is securely transferred to a subsequent buyer or retired. Aquarelia utilizes standard C2PA signatures to track asset provenance but does not guarantee the baseline copyright validity of the underlying content and is not legally liable for intellectual property disputes.
Eligibility & Account Creation
You must be at least 14 years of age to create an account on Aquarelia. However, to complete any financial transactions, including purchasing, selling, or auctioning digital assets, you must be at least 18 years old or possess explicit, verifiable consent from a parent or legal guardian. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities linked to your profile.
Marketplace Transactions & Fees
Aquarelia operates as a premium digital asset marketplace. We integrate Stripe Connect as our secure third-party payment processor. By completing a financial transaction on the platform, you simultaneously agree to Stripe’s binding Terms of Service and processing latency.
Aquarelia absorbs all payment provider processing and payout transfer fees (including debit cards, credit cards, direct bank debits, PayPal, and Stripe processing fees), guaranteeing that creator and seller payouts are received as exact net amounts with zero hidden deductions.
- Primary Sales: Aquarelia applies an 18% protocol fee on all initial primary market sales to fund the platform, computational architecture, and secure ledger monitoring. Aquarelia absorbs all processing and payout fees, so the original creator receives an exact 82% net payout of the transaction value.
- Secondary Sales & Royalties: For secondary market resales, the original creator automatically receives an ongoing royalty of up to 6% mapped to their profile on every secondary trade involving their work. Aquarelia applies a 14% protocol fee (absorbing all payment and transfer fees), ensuring the reseller receives an exact 80% net payout (when creator royalty is 6%).
All executed sales are final. Live auctions with active bids cannot be canceled or withdrawn under any circumstances to protect buyer capital and marketplace trust. Direct Buy and Open Offers may be canceled at any time prior to execution.
Acceptable Use & Content Guidelines
We deploy advanced, real-time media filtering to ensure a premium ecosystem. Any attempts to upload explicit/pornographic material, non-consensual imagery, graphic violence, activist campaigns, or targeted harassment towards others will be automatically rejected. By accepting these terms of service, you also agree not to engage in malicious activities, including exploiting platform vulnerabilities, data scraping, utilizing compromised files, or engaging in algorithmic manipulation. Violations of these guidelines grant Aquarelia the explicit legal right to terminate your account immediately and execute a permanent "retire" state regarding non-compliant assets.
Account Termination & Data Removal
You may request to delete your account at any time within your settings. This initiates a secure 20-day grace period. If the account is not reactivated within this window, the deletion query becomes irreversibly permanent. Your core node ID, direct messages, and server links to previously generated assets are cleanly severed, leaving no footprint behind on the network. Aquarelia also reserves the right to suspend or terminate accounts that breach these Terms.
Spirit of Aquarelia & Discretionary Access
The Spirit of Aquarelia & Discretionary Access operates under a uncompromising and comprehensive ethos. We are dedicated to the pursuit of aesthetic excellence, true beauty and celebrating the wonders of the digital world. At our sole discretion, we reserve the right to restrict, suspend, or permanently revoke your access to the platform if your behavior fundamentally misaligns with this philosophy. Specifically, we may enforce these restrictions for two primary reasons:
- Incompatible Content: Uploading artwork that circumvents safety standards or degrades the platform’s premium aesthetic is forbidden, such as emphasis on drugs, deliberately provocative content, or excessive "e-girl" visuals. There are other forums for this; our focus remains strictly on elevating what art can be.
- Aggressive Speculation: We are an art sanctuary, not a financial trading application. If your sole behavioral pattern on the platform revolves entirely around predatory market-making, high-frequency flipping, or trading exclusively to extract profit rather than genuinely collecting art, we reserve the right to prevent you from accessing our ecosystem.
- Safeguarding our Community: To preserve a pristine place for genuine creators and collectors, Aquarelia reserves the right to immediately suspend or terminate fake accounts that engage in spam, automated commercial activity, impersonation or behavior inconsistent with our community standards and platform vision.
Limitation of Liability
The Platform is provided on an "as is" and "as available" basis without warranties of any kind. Aquarelia acts strictly as an algorithmic ledger and is not responsible for financial losses, uninterrupted network access, or the actions of independent users.
