Acceptance of Terms & Eligibility
By accessing or using the Aquarelia.io platform, you formally agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and continued use of the platform constitutes acceptance of any updates.
You must be at least 14 years of age to browse and create an account on Aquarelia. To participate in financial transactions, including acquiring, listing, or auctioning digital assets, you must be at least 18 years old or possess verifiable consent from a parent or legal guardian. You remain solely responsible for the confidentiality of your credentials and all activity on your profile.
An Ecosystem for Digital Art
Aquarelia is a dedicated sanctuary for generative digital art, fundamentally distinct from decentralized finance platforms and speculative trading apps. We do not operate within speculative frameworks, nor do we encourage high-frequency flipping or predatory market-making. Our purpose is to empower creators to flourish by publishing original works, and to provide collectors with a space to discover and cherish art that deeply resonates with them.
Intellectual Property, C2PA Provenance & Prompt Rights
The original creator retains underlying authorship and moral rights to their generated artwork. Upon a verified marketplace transaction, exclusive commercial usage rights to the certified asset transition mathematically to the buyer until subsequently transferred or retired. Where a creator chooses to unlock or package generative prompt parameters with the artwork, the buyer receives full access to utilize those creative formulas within platform guidelines.
Aquarelia utilizes open-web C2PA cryptographic signatures to permanently record asset provenance. Aquarelia operates strictly as an intermediary marketplace infrastructure; we do not warrant the third-party copyright validity of submitted prompts or outputs, and each user warrants that their submissions do not infringe upon any third-party intellectual property.
Marketplace Transactions, Fees & Royalties
Financial transactions on Aquarelia are processed securely through licensed partners including Stripe Connect. By transacting on the platform, you agree to the applicable terms and processing standards of our financial providers. Aquarelia absorbs standard payment provider processing and payout transfer fees, ensuring creator and seller payouts reflect exact net figures:
- Primary Sales: Aquarelia retains an 18% protocol fee on initial sales to sustain computational architecture, edge routing, and C2PA noticeboard monitoring. The original creator receives an exact 82% net payout.
- Secondary Resales & Royalties: On secondary resales, the original creator automatically receives an ongoing royalty of up to 5%. Aquarelia applies a 15% protocol fee (absorbing payment processing costs), guaranteeing the seller an exact 80% net payout (when creator royalty is 5%).
All completed sales are final. Active auction bids cannot be withdrawn once placed to preserve auction integrity and marketplace trust. Direct Buy listings and Open Offers may be amended or revoked at any time prior to execution.
Creator Balances, Settlement & Multi-Rail Payouts
Non-Banking Stored Value Disclaimer: The balance shown in your creator dashboard represents accrued commercial revenue and royalties owed to you by the platform. It is not a bank account, deposit facility, or stored-value wallet. It cannot receive personal deposits, does not accrue interest, and is not covered by deposit guarantee schemes.
Limited Collection Agent: You formally appoint Aquarelia as your authorized limited payment collection agent solely for the purpose of receiving payments from buyers on your behalf. Receipt of payment by Aquarelia fully satisfies the buyer’s financial obligation to you.
Settlement & Multi-Rail Transfers: Platform earnings are immediately credited and available for withdrawal upon successful sale. Once credited, funds in your "Available for Payout" balance can be transferred via supported payout rails (Direct Bank Deposit, Push-to-Card, Wise, or supported digital asset rails), subject to a standard $10.00 USD minimum threshold and banking clearance schedules. Payouts require successful identity verification (KYC) through our payment partners.
Acceptable Use, Content Filtering & Community Standards
We deploy automated, real-time synthetic media filtering. Submissions containing explicit or pornographic material, non-consensual imagery, graphic violence, child exploitation, extreme activist campaigns, or targeted harassment will be blocked immediately.
To preserve an authentic community, users agree not to engage in platform manipulation, data scraping, automated commercial spam, account impersonation, or predatory high-frequency flipping. Aquarelia reserves full discretionary authority to restrict access, suspend accounts, or permanently retire assets that violate these standards.
Account Deletion & Data Retention
You may request account deletion at any time in your Settings, initiating a secure 20-day grace period. If not reactivated within this window, your account, node identifier, direct messages, and server records are cleanly and permanently severed. In accordance with open-web standards, C2PA cryptographic signatures embedded in previously downloaded media remain immutable offline records of provenance.
Disclaimers, Indemnification & Limitation of Liability
Aquarelia is provided on an "as is" and "as available" basis without warranties of any kind. Aquarelia functions strictly as an algorithmic noticeboard and marketplace intermediary and is not liable for financial losses, network latency, or independent user conduct.
You agree to indemnify and hold harmless Aquarelia, its operators, and affiliates from any third-party claims, damages, or liabilities arising from your submitted artwork, prompt recipes, or breach of these Terms.
